However, open air theatres will be permitted to open with effect from September 21, 2020.<\/p>\n<p>3.International air travel of passengers, except as permitted by MHA.<\/p>\n<p>4.Social\/academic\/sports\/entertainment\/cultural\/religious\/political functions and other congregations with a ceiling of 100 persons, will be permitted with effect from September 21, 2020, with mandatory wearing of face masks, social distancing, provision for thermal scanning and hand wash or sanitizer.<\/p>\n<p>&nbsp;<\/p>\n<h2><span style=\"color: #ff0000;\"><b>2. Change in TCS-Section 206C\u00a0 &amp; its implications<\/b><\/span><\/h2>\n<p>&nbsp;<\/p>\n<p><u><b>Background<\/b><\/u><\/p>\n<p>Indian Income Tax act has the provisions for tax collection at source. Section 206C of the Income-tax act governs the goods on which the seller has to collect tax from the buyer at the time of sale. In order to widen the tax brackets Government has come forward with some more item to be covered. New Item has been proposed in the Union Budget 2020 and was applicable from April, 01st 2020 but later on as per Finance Act 2020, it will be applicable from October, 01st 2020.<\/p>\n<p>&nbsp;<\/p>\n<p>Let\u2019s discuss the provisions of TCS in detail:<\/p>\n<p>\u00d8<b><i>Item covered<\/i><\/b><\/p>\n<ul>\n<li><u>Existing Covered Item<\/u>: Existing item covered under TCS provisions and rates applicable to them<\/li>\n<li><u>New Item covered<\/u>:<\/li>\n<\/ul>\n<p>a.TCS on Sale of Goods- 206C(1H)<\/p>\n<p>b.TCS on Foreign Remittance &amp; Export of Goods out of India)<\/b><\/span><\/h4>\n<p><b>Applicability<\/b>: If <b>consideration exceeds INR50 lakhs <\/b>in a year\u00a0 and\u00a0 TCS \u00a0 will be collected at the time of receipt on the amount exceed\u00a0 INR50 lakhs<\/p>\n<p><b>Rate\u00a0 :<\/b>TCS @<b>0.1%<\/b> (.075% until 31 March 2021 as per Covid-19 \u00a0 relief by the CBDT) <b>(In non PAN\/Aadhar case-1%)<\/b><\/p>\n<p><b>Lower Deduction Certificate: <\/b>No option to get certificate at Lower\/Nil rate.<\/p>\n<p><b>Sellers<\/b>\u00a0means whose total sales, gross receipts or turnover from the business carried on by it\u00a0<b>exceed INR 10 crore <\/b>\u00a0during the financial year immediately preceding the financial year but doesn\u2019t include the person as the CG notifies.<\/p>\n<p><b>Buyer<\/b> means a person who purchases any goods but does not include:<\/p>\n<p>a.Buyer is liable to deduct TDS and has withheld such amount<\/p>\n<p>b.Buyer is<\/p>\n<p>-Central Government\/ State Government\/Embassy \/ High Commission \/ Legation \/ Commission \/ Consulate \/ Trade Representation of a Foreign State\/\u2013 Local Authority such as Panchayat, Municipality etc.<\/p>\n<p>\u2013 Person importing goods into India<\/p>\n<p>\u2013 any other person as notified by the Central Govt.<b> (No notification issued till date).<\/b><\/p>\n<p>&nbsp;<\/p>\n<h4><span style=\"color: #ff0000;\"><b>Case Study 1- Whether Sale consideration inclusive of GST or not?<\/b><\/span><\/h4>\n<p>&nbsp;<\/p>\n<p><img decoding=\"async\" class=\"alignnone size-medium wp-image-3255\" src=\"https:\/\/www.knmindia.com\/japanese\/wp-content\/uploads\/2018\/12\/case-study-1-640x202.png\" alt=\"\" width=\"640\" height=\"202\" srcset=\"https:\/\/knmindia.com\/japanese\/wp-content\/uploads\/2018\/12\/case-study-1-640x202.png 640w, https:\/\/knmindia.com\/japanese\/wp-content\/uploads\/2018\/12\/case-study-1-768x243.png 768w, https:\/\/knmindia.com\/japanese\/wp-content\/uploads\/2018\/12\/case-study-1-320x101.png 320w, https:\/\/knmindia.com\/japanese\/wp-content\/uploads\/2018\/12\/case-study-1.png 825w\" sizes=\"(max-width: 640px) 100vw, 640px\" \/><\/p>\n<h5><strong>Now CBDT has clarified by Circular no17\/2020 that since it\u2019s a collection based tax, so no adjustment is required for any discount, sales return, or indirect taxes<\/strong><\/h5>\n<p>&nbsp;<\/p>\n<p>As the provision suggest, <i>Every person, being a seller, <\/i><b><i>who receives any amount as consideration for sale of any goods<\/i><\/b><i> of the value or aggregate of such value exceeding fifty lakh rupees in any previous year, Therefore the sale price received <\/i><b><i>including GST should be sales consideration.
